Terms of use

Version of 15 October 2026.

1. Scope

These terms apply between Thru The Heart Creative GmbH, Kirchengasse 48/8, 1070 Vienna, Austria (we), and everyone who uses engenty.ai, an engenty wizards account, our model gateway, the studio on engenty.ai or the templates of the gallery (you). Other terms apply only if we agree to them in writing. How we handle personal data is described in our privacy policy.

Privacy policy

2. What we offer

  • The engenty wizards app for your own computer. It comes with its own licence, the Functional Source License (FSL-1.1-MIT): you may use, change and share it freely, just not for an offer that competes with engenty wizards. Each version becomes MIT two years after its release.
  • The account at account.engenty.ai: team, plan (Free, Pro, Team), credits, API keys and invoices.
  • The model gateway, through which wizards use AI models for text, images, video and voice with credits.
  • The studio on engenty.ai, spaces, the cloud runtime that runs wizards for you, and the links, pages and addresses with which you share and publish wizards.
  • Channels and plugins such as chat, WhatsApp, SMS and calls, and the modules of your plan. They rely on services of other providers.
  • The template gallery at engenty.ai/wizards.

engenty wizards is at an early stage: features may change. We aim for smooth operation but promise no particular availability.

3. Account

Anyone at least 16 years old can open an account; whoever buys credits must have full legal capacity or act with consent. Keep access to your account and your API keys secret; whatever happens with them counts as your account’s doing. A team can have several people; whoever invites a person is responsible for that person keeping to these terms.

You can have your account deleted at any time: write to contact@engenty.ai. If someone breaks these terms or the law, we may block the account; for a minor breach we first ask for it to be put right.

4. Credits and payment

You pay for models that run through our gateway with credits. 1 credit equals 1 cent. You see what a model costs in your account before you use it; the price depends on usage (tokens, images, seconds).

You buy credits in packages in the account, paid through Stripe. Prices are shown there before you buy, including VAT for consumers. A credit package is a one-time payment, not a subscription.

The Pro and Team plans are subscriptions. Each month they cost, in advance, the price shown in the account before you subscribe, and each month they bring the credits, spaces, team places and features named there. A subscription renews every month until you cancel it in the account; it then ends with the paid month, after which Free applies. If you change plans, the new one applies at once and Stripe charges or credits the difference pro rata.

Bought credits do not expire. Gifted or monthly credits are used first and expire on the date shown in the account. Because a running call is charged when it ends, the balance can drop slightly below zero; the next top-up evens it out. Credits are not paid out in money and cannot be transferred.

5. Right of withdrawal for consumers

If you buy credits as a consumer, you can withdraw from the contract within 14 days of the purchase without giving a reason. An email to contact@engenty.ai with your name and the purchase is enough. We refund the amount within 14 days by the means you paid with.

When you buy, you can ask us to perform at once so the credits can be used right away. The right of withdrawal then ends as soon as you use credits from that purchase (§ 18(1)(11) FAGG). It remains for credits you have not used. After the 14 days we do not refund credits, except where the law requires it.

For a subscription (Pro, Team) the right of withdrawal applies in the same way within 14 days of subscribing. If you ask us to perform at once when you subscribe, it ends as soon as you use credits from the subscription; if you withdraw before that, you pay the share until the withdrawal (§ 16 FAGG).

6. Your content, published wizards and AI results

What you put in and what your wizards produce belongs to you, as far as any rights arise in it at all. You grant us only the rights we need to process it, store it and show it the way you set it (for example through a shared link).

You are responsible for holding the rights to what you put in and for using results lawfully. AI results can be wrong, incomplete or similar to others’ work: check them before you rely on them or publish them, and label AI-generated content where the law requires it (such as the EU AI Act).

Responsibility for everything produced under your account. You are responsible for all content that is entered, produced or sent under your account or team, whether you did it yourself or your wizards, agents, runners, automations or channels did it for you, and whether or not you were watching. If a third party makes a claim against us because of such content (for example for copyright, personality rights, data protection, competition law or missing AI labelling), you stand in for it: you take over the defence, indemnify us and hold us harmless, including reasonable legal costs. We tell you about the claim without delay and do not settle it without you. For consumers this applies only as far as they are liable by law.

Takedown. If there is a claim or a clear breach of these terms, we may take content or published wizards offline, or pause the runs, without being liable for it.

6a. Published wizards

When you publish a wizard, share it by link or put it in the gallery, you grant us a worldwide, non-exclusive, free licence, for as long as it is published and for the copies we need afterwards (such as backups and runs in progress), to host, run, show, copy, translate, list and promote it, and to let others use it as you set it. This is free of charge for us and for the people who use it: nobody, neither you nor anyone who has rights in the wizard or its parts, may demand fees, royalties or other payments from us or from them for that use. This applies to every plan, and on Free it is the condition for publishing. You confirm that you hold all rights needed for it.

Addresses are part of our service, not of your wizard. Shared links, run pages, domains and vanity addresses (for example on wizards.pages) stay ours. We may change, move, rename, replace or retire them at any time, for example to introduce new addresses, and we do not promise that an address stays. Where we can, we redirect the old address to the new one, but we owe you no redirect.

7. What is not allowed

  • Content that breaks the law or infringes others’ rights (copyright, personality rights, data protection)
  • Deceptively real images, videos or voices of real people without their consent
  • Malware, attacks on our or others’ systems, getting around limits and blocks
  • Reselling access to our gateway to third parties or offering it as a service of your own
  • Uses that the policies of a model’s provider forbid
  • Sending unwanted messages in bulk (spam) with wizards
  • Making calls or sending messages through channels (WhatsApp, SMS, calls) that the recipient did not agree to, or that break the rules of the channel or its provider
  • Using the API with a client that hides what it is, or in a way that bypasses the limits of your plan

8. Liability

We are liable without limit for intent and gross negligence and for personal injury. We are not liable for slight negligence, except for personal injury. We give no warranty for the content AI models produce or for services of other providers you connect to engenty wizards or that carry channels for it (such as messaging and telephony providers). Addresses and links may change or be unavailable; we are not liable for that. Mandatory consumer rights, such as the statutory warranty, remain unaffected.

9. Changes

We may change these terms when our offer or the law changes. We announce changes by email at least 30 days in advance. If you do not agree, you can object until then and have your account deleted; we then refund any bought credits you have not used. The version in force is always on this page.

Technical changes that do not touch your rights, such as new or changed addresses, links and domains, or changes to free features, take effect when announced on the page or in the account.

10. Law and place of jurisdiction

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers this applies only as far as it does not take away the protection of the mandatory rules of their country of residence. The place of jurisdiction for businesses is Vienna; consumers can sue and be sued where they live.
